1. Acceptance of Terms
By accessing or using Manifest (the "App"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not access or use the App. These Terms form a legally binding agreement between you and NOMADSLIM LLC (Delaware, United States of America) ("we", "us", or "our").
2. Description of the Service
Manifest is a meditation and identity-change application that helps users (i) create a clear personal vision using AI-assisted generation, (ii) track a daily meditation habit, and (iii) complete a single daily action intended to reinforce desired beliefs and behaviors. The App may evolve over time. We may add, remove, or modify features, content, and functionality at any time, including releasing updates, new versions, and changes to plans or pricing.
3. Eligibility and Age Requirements
You must be at least 18 years old to use the App. If you are under 18, you may not create an account or use the App. By using the App, you represent and warrant that you meet these eligibility requirements and that your use of the App does not violate any applicable laws in your jurisdiction.
4. Important Notices: Not Medical Advice; Not Emergency Services
THE APP IS NOT A MEDICAL, THERAPEUTIC, OR DIAGNOSTIC SERVICE AND DOES NOT PROVIDE MEDICAL OR MENTAL HEALTH ADVICE. The App is intended for general informational, educational, and motivational purposes only. If you are experiencing a medical or mental health emergency, thoughts of self-harm, or symptoms that may require urgent care, you must seek immediate help from emergency services or qualified professionals. You are solely responsible for your decisions, actions, and outcomes.
5. Account Registration and Security
To use certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. If you believe your account has been compromised, you must notify us promptly at contact@senseislim.com. We are not responsible for any loss or damage resulting from unauthorized access to your account due to your failure to safeguard credentials.
6. Your Responsibilities and Safe Use
You agree to use the App responsibly and to take reasonable care of your physical and mental well-being. You should not use the App in a way that is unsafe, including while driving, operating machinery, or performing activities requiring full attention. If you experience dizziness, pain, panic, or distress during meditation or breath-related practices (if any), stop immediately and seek professional guidance if needed.
7. Subscriptions, Billing, and Payments
The App may offer paid subscriptions and/or one-time purchases. Pricing, billing intervals, and benefits are shown at the time of purchase. Web purchases may be processed via Stripe or other payment processors. iOS subscriptions and purchases may be processed by Apple via your App Store account. Android subscriptions and purchases may be processed by Google via your Google Play account. By purchasing, you authorize the applicable processor (Stripe, Apple, or Google) to charge your selected payment method. Subscriptions typically auto-renew unless canceled before the end of the then-current billing period. You are responsible for managing your subscription, including cancellation, through the relevant platform (e.g., App Store, Google Play, or your web account settings, depending on where you subscribed).
8. Free Trials, Promotional Pricing, and Plan Changes
We may offer free trials, promotional pricing, discount codes, or limited-time offers. Unless otherwise stated, trials may automatically convert to a paid subscription at the end of the trial period, and you will be charged unless you cancel before the trial ends. We may change subscription plans, features, and pricing at any time, subject to applicable laws and platform rules. If required, we will provide advance notice (e.g., in-app or by email).
9. Refunds and Chargebacks
Refund eligibility depends on where you purchased. If you purchased on the web (e.g., via Stripe), refunds (if any) are governed by our Refund Policy. If our Refund Policy provides a money-back guarantee, you must follow the procedure described there. If you purchased through Apple (App Store) or Google (Google Play), refunds are generally handled by the platform and subject to the platform's refund rules. In many cases, we cannot directly issue refunds for platform purchases. You agree not to initiate a chargeback or payment dispute without first contacting us at contact@senseislim.com and making a good-faith effort to resolve the issue. We may suspend or terminate accounts associated with excessive or abusive refund requests, chargebacks, or payment disputes, to the extent permitted by law.
10. AI Features and AI-Generated Content
The App may use third-party AI services (including OpenAI or similar providers) to generate text-based outputs, such as vision statements, prompts, or guidance. AI-generated content may be inaccurate, incomplete, or not suitable for your specific circumstances. AI outputs are not professional advice and should not be relied upon as medical, psychological, legal, or financial advice. You are solely responsible for how you interpret and use any AI-generated content. We do not guarantee any specific results, changes, outcomes, or performance improvements from using the App, including from AI-generated content.
11. User Content, Inputs, and License
You may submit information, text, preferences, goals, and other materials to the App ("Inputs"). You represent and warrant that you have the right to provide your Inputs and that your Inputs do not violate any laws or third-party rights. You grant us a limited, worldwide, non-exclusive license to use your Inputs solely to operate, maintain, and improve the App, provide the services you request, prevent abuse, and comply with legal obligations, as further described in our Privacy Policy. You remain responsible for your Inputs and for any content you create or store using the App.
12. Acceptable Use and Prohibited Conduct
You agree not to: (a) use the App for any unlawful, fraudulent, or harmful purpose; (b) attempt to gain unauthorized access to the App, accounts, systems, or networks; (c) interfere with or disrupt the App, servers, or security features; (d) probe, scan, or test the vulnerability of any system or network; (e) reverse engineer, decompile, disassemble, or attempt to derive source code or underlying algorithms (except to the extent prohibited by law); (f) use automation, scraping, or abusive usage patterns that degrade service; (g) upload or transmit malware, viruses, or malicious code; (h) harass, threaten, defame, or otherwise harm others; (i) impersonate any person or entity, or misrepresent your affiliation; (j) use the App to generate or distribute content that violates applicable laws or third-party rights. We may investigate and take appropriate action, including suspension or termination, if we believe you violated these Terms.
13. Intellectual Property
The App and all associated content, features, designs, text, graphics, logos, and software are owned by NOMADSLIM LLC or its licensors and are protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the App or any part of it without our prior written consent.
14. Third-Party Services and Links
The App may integrate or rely on third-party services (e.g., payment processors, analytics, hosting, AI providers) and may contain links to third-party websites or services. We do not control and are not responsible for third-party services, their content, their availability, or their practices. Your use of third-party services may be subject to their own terms and policies. You are responsible for reviewing and complying with those third-party terms.
15. Privacy, Data, and Account Deletion
Your privacy is important to us. Our Privacy Policy explains how we collect, use, disclose, and protect personal data. You can typically manage key account settings within the App. If the App provides a self-service account deletion feature, you can use it to request deletion of your account and associated data. In some cases, we may retain certain information as required by law, for legitimate business purposes (such as fraud prevention, security, auditing, and compliance), or as described in our Privacy Policy. 16. Availability, Updates, and Maintenance
We strive to keep the App available, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, technical issues, or factors outside our control. We may deploy updates that change or remove features. Some updates may be required for continued use. You are responsible for installing updates and maintaining compatible devices, operating systems, and internet access.
17. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT OR GUARANTEE ANY RESULTS FROM USING THE APP, INCLUDING ANY CHANGES IN MOOD, IDENTITY, HABITS, OUTCOMES, OR LIFE CIRCUMSTANCES.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOMADSLIM LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE APP IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
19. Indemnification
You agree to defend, indemnify, and hold harmless NOMADSLIM LLC, and its members, managers, contractors, and service providers, from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your Inputs or any content you submit; (c) your violation of these Terms; (d) your violation of any law or the rights of any third party.
20. Termination and Suspension
We may suspend or terminate your access to the App, your account, and/or any subscription at any time if we reasonably believe you violated these Terms, created risk or legal exposure, engaged in fraud or abuse, or if required by law. You may cancel your subscription at any time through the platform or method used to subscribe (App Store, Google Play, or web account settings). Termination does not relieve you of payment obligations already incurred. Upon termination, your right to use the App will cease immediately.
21. Export Controls and Sanctions
You may not use, export, re-export, or transfer the App except as authorized by applicable law. You represent that you are not located in, under the control of, or a national or resident of any country subject to comprehensive sanctions, and that you are not on any restricted-party list, to the extent such restrictions apply to your use of the App.
22. Governing Law; Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States of America, without regard to conflict of law principles. Before filing a claim, you agree to contact us at contact@senseislim.com and attempt to resolve the dispute informally. To the extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the App that cannot be resolved informally will be brought in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts. Nothing in these Terms prevents either party from seeking injunctive or equitable relief for unauthorized use of intellectual property or breach of confidentiality.
23. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may provide notice through the App and/or by email. Your continued use of the App after the effective date of updated Terms constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using the App and cancel any subscription.
24. Miscellaneous
Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. No Waiver: Our failure to enforce any right or provision is not a waiver of that right or provision. Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, corporate restructuring, or sale of assets. Entire Agreement: These Terms, together with any policies referenced (including the Privacy Policy and Refund Policy), constitute the entire agreement between you and us regarding the App.
